The agreement that governs your use of FlyData Global.
Agreement
These Terms of Service (“Terms”) form a legally binding agreement between you and FlyData Global (“FlyData Global,” “we,” “us,” or “our”). These Terms govern your access to and use of our website, mobile applications, eSIM products, and related services (collectively, the “Services”).
FlyData Global provides a platform through which customers can purchase, install, activate, and manage eSIMs and mobile data plans for use on local, regional, and international mobile networks.
By registering for an account or otherwise accessing or using our Services, you confirm that you have reviewed these Terms and agree to comply with them. If you do not accept these Terms, you must not use our Services.
If you access or use the Services on behalf of a company, organization, or other legal entity, you represent that you have the authority to accept these Terms on its behalf.
We may restrict, suspend, or terminate access to the Services when we reasonably believe that these Terms have been violated.
1. Our Services
FlyData Global offers digital connectivity solutions that enable customers to purchase and manage eSIM-based mobile data services.
Depending on availability and location, the Services may allow you to:
Browse and purchase local, regional, and international eSIM data plans.
Install and activate eSIMs using QR codes or other activation information.
Check data balances, usage information, and purchase history.
Share eligible eSIM information through supported communication methods.
Manage your account details, payment options, and service preferences.
We may add new features, change existing functionality, or discontinue certain Services from time to time, subject to applicable law.
2. Eligibility and Account Creation
To access or use our Services, you must satisfy the following requirements:
You must be at least 18 years old, unless applicable law permits use with the involvement or consent of a parent or legal guardian.
You must have a compatible device capable of supporting eSIM technology.
You must provide complete and accurate information when creating or maintaining an account.
You may register using an email address or supported third-party sign-in services, such as Google or Apple.
You are responsible for keeping your account information current and accurate.
3. Protecting Your Account
You are responsible for safeguarding your login credentials, password, and any other authentication method connected to your account.
Unless you notify us of unauthorized access, activity performed through your account may be treated as activity authorized by you.
If you believe that someone has accessed your account without permission, you should contact FlyData Global as soon as possible.
We are not responsible for losses resulting from your failure to reasonably protect your account credentials or devices.
4. Permitted and Prohibited Use
You may use the Services only for lawful purposes and in compliance with applicable laws and regulations.
You must not:
Introduce viruses, malware, or other harmful software into our Services.
Attempt to bypass, disable, compromise, or interfere with security features.
Violate the intellectual property, privacy, or other legal rights of another person or organization.
Distribute fraudulent, unlawful, abusive, threatening, defamatory, hateful, obscene, or deceptive content.
Pretend to be another person or provide false information about your identity.
Use the Services in a manner that could create legal, financial, or security risks for FlyData Global or its partners.
Violation of these rules may result in immediate suspension or permanent closure of your account.
5. Orders and Payments
Purchases made through FlyData Global are subject to payment approval and product availability.
When placing an order, you understand and agree that:
The applicable price will be presented before you complete payment.
Prices may differ based on destination, plan size, promotions, taxes, or other applicable factors.
Only payment methods made available during checkout may be used.
Payment information is handled by authorized payment service providers, and FlyData Global does not ordinarily retain complete payment card details.
After successful payment, the purchased eSIM or data plan will generally be provided promptly. However, delays may occur due to technical issues, network conditions, verification requirements, or other circumstances outside our reasonable control.
6. eSIM and Data Plan Conditions
Each eSIM or data plan may have its own specific:
Coverage area.
Validity period.
Data allowance.
Network limitations.
Activation requirements.
Other applicable restrictions.
You are responsible for selecting a plan suitable for your intended destination and connectivity needs.
You are also responsible for monitoring your available data and purchasing additional data when necessary.
Unless expressly stated otherwise, unused data expires when the applicable validity period ends.
7. Device Compatibility
FlyData Global provides eSIM services for devices that support eSIM technology.
While we may provide compatibility guidance or tools, you remain responsible for confirming that your device:
Supports eSIM technology.
Is carrier-unlocked where necessary.
Is compatible with the relevant network or destination.
A device's inability to support eSIM functionality does not automatically qualify a customer for a refund.
8. Permission to Use the Services
Subject to your compliance with these Terms, FlyData Global grants you a limited, personal, revocable, non-exclusive, and non-transferable right to access and use the Services for personal or legitimate internal business purposes.
Unless we provide written permission, you may not:
Sell, sublicense, rent, or commercially exploit the Services.
Copy, reproduce, alter, or create derivative works from our applications or platform.
Reverse engineer, decompile, or attempt to identify source code.
Disrupt the operation, security, or availability of the Services.
Use automated tools to scrape, extract, or collect information from the platform without authorization.
All rights not specifically granted to you remain with FlyData Global or the relevant rights holders.
9. Charge-backs and Payment Disputes
Except where required by applicable law or covered by an applicable refund policy, purchases may be considered final once an eSIM or data plan has been delivered, activated, or made available for use.
If you initiate a chargeback, payment reversal, or dispute through your bank or payment provider:
Your account may be temporarily restricted while the matter is reviewed.
FlyData Global may provide relevant evidence showing that the order was processed, delivered, activated, or used.
You may remain responsible for amounts or costs associated with invalid or unsuccessful payment disputes where permitted by law.
Repeated, abusive, or fraudulent disputes may result in permanent account closure and may be reported to appropriate payment providers or authorities.
10. Fraud and Security Protection
FlyData Global uses reasonable measures to identify suspicious or potentially fraudulent activity in order to protect customers, payment providers, telecom partners, and our business.
You must not:
Use stolen or unauthorized payment methods.
Create accounts using false or deceptive information.
Manipulate, duplicate, resell, or misuse eSIM products without authorization.
Attempt to bypass payment verification or security systems.
Exploit or interfere with the operation of our Services.
Where suspicious activity is identified, we may, where legally permitted:
Suspend or close an account.
Cancel pending transactions.
Disable affected services.
Decline future transactions.
Share relevant information with payment providers, telecom partners, fraud prevention providers, or law enforcement authorities.
Take other reasonable steps necessary to protect the Services and our customers.
11. Third-Party Providers
Some aspects of our Services rely on independent third parties, including:
Mobile network operators.
Payment processors.
Cloud service providers.
Technology and infrastructure partners.
Because these providers operate independently, FlyData Global cannot guarantee uninterrupted service when an issue originates outside our reasonable control.
We are not responsible for outages, delays, or failures caused by third-party systems, although we will make reasonable efforts to restore or support affected Services when possible.
12. Your Obligations
When using FlyData Global, you agree to:
Follow applicable laws and regulations.
Provide truthful and current information.
Protect your account credentials.
Use the Services responsibly.
Avoid conduct that could disrupt or compromise the platform.
Cooperate with reasonable security or fraud-related investigations.
Failure to meet these obligations may result in restrictions, suspension, or termination of your account.
13. Breach of These Terms
FlyData Global may investigate suspected violations of these Terms.
Depending on the circumstances, we may remove content, restrict access, suspend accounts, terminate Services, or take other reasonable measures necessary to protect our customers, partners, platform, and legal interests.
We may also cooperate with payment providers, telecom operators, regulators, or law enforcement authorities when required by law or reasonably necessary to investigate suspected unlawful or fraudulent activity.
We are not required to monitor every user activity, but we reserve the right to review activity when appropriate.
14. Inactive Accounts
To help maintain the security and efficient operation of our platform, FlyData Global may restrict or remove accounts that remain inactive for an extended period.
Where applicable, inactive free accounts or expired trial accounts may be deleted after reasonable notice, subject to applicable law.
15. Changes to Services and Prices
We continually develop and improve our Services. As a result, we may modify, replace, pause, or discontinue features, products, functionality, or pricing.
Where practical, we may provide notice of significant changes, planned maintenance, or anticipated service interruptions through our website, application, or email communications.
Prices for eSIMs and data plans may change over time. Such changes will generally not affect purchases that have already been successfully completed.
We may also update these Terms to reflect changes in our Services, legal obligations, or business practices. Updated Terms become effective when published unless a different effective date is stated.
By continuing to use the Services after updated Terms take effect, you accept the revised Terms.
16. Intellectual Property Rights
Unless otherwise indicated, the intellectual property associated with the FlyData Global platform—including software, branding, logos, trademarks, designs, graphics, text, interfaces, databases, and other proprietary materials—belongs to FlyData Global or its licensors.
You retain ownership of information or content that you submit through your account. However, you grant us the limited rights necessary to process, store, transmit, and display that information solely to operate and provide the Services.
We may use anonymized and aggregated information to improve our products, analyze performance, prepare statistical reports, and better understand service usage, provided that such information does not reasonably identify you personally.
You may not copy, distribute, reproduce, modify, publish, reverse engineer, or otherwise exploit any portion of the FlyData Global platform without prior written authorization, except where applicable law expressly permits such activity.
Personal information is handled in accordance with our Privacy Policy and applicable data protection laws.
17. Access by Authorized Personnel
In certain situations, authorized FlyData Global personnel may need limited access to your account to:
Investigate technical problems.
Provide customer support.
Resolve billing or account issues.
Protect the security and reliability of our Services.
When you request support, you authorize reasonable account access necessary to address your request.
If you have concerns about access to specific information, please notify our support team. We will consider reasonable restrictions where possible, although certain issues may require limited access in order to be resolved.
18. Indemnification
You agree to defend, indemnify, and hold harmless FlyData Global, its affiliates, directors, officers, employees, contractors, licensors, and partners from claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising from:
Your improper use of the Services.
Your violation of these Terms.
Your breach of applicable laws or regulations.
Your violation of another person's intellectual property, privacy, or legal rights.
Activity conducted through your account by you or someone authorized by you.
These obligations may continue after your account or access to the Services ends.
19. Disclaimer of Warranties
The Services are provided on an “as available” and “as is” basis.
To the maximum extent allowed by applicable law, FlyData Global does not make guarantees or warranties regarding uninterrupted availability, accuracy, reliability, or suitability of the Services for a particular purpose.
We do not guarantee that:
The Services will always operate without interruption.
Every error or technical problem will be corrected immediately.
Mobile coverage will be available in every location.
Third-party network operators will provide uninterrupted connectivity.
The Services will always be completely free from technical, security, or other issues.
Mobile connectivity depends on telecommunications networks and internet infrastructure that may be outside our control. Service interruptions or limitations may therefore occur.
Nothing in this section removes rights that cannot legally be excluded.
20. Limitation of Liability
To the fullest extent permitted by applicable law, FlyData Global will not be responsible for indirect, incidental, special, punitive, or consequential losses arising from your use of, or inability to use, the Services.
This may include:
Lost profits.
Lost business opportunities.
Loss of data.
Business interruption.
Loss of goodwill.
Costs resulting from third-party network outages.
Where liability cannot legally be excluded, FlyData Global's total liability for a claim relating to the Services will not exceed the amount you paid for the affected Services during the 180 days before the event that gave rise to the claim.
These limitations apply regardless of the legal basis of a claim, including contract, negligence, tort, or statutory liability.
21. Governing Law and Disputes
These Terms will be governed and interpreted according to the laws of the jurisdiction in which FlyData Global is legally incorporated, except where mandatory consumer protection laws require otherwise.
Disputes arising from these Terms or the Services will generally be handled by courts with jurisdiction over FlyData Global's principal place of business, unless applicable law provides otherwise.
Before beginning formal legal proceedings, both parties agree to make reasonable efforts to resolve disputes through good-faith discussions.
22. General Terms
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will remain effective.
Our failure to enforce a provision does not mean that we have waived our right to enforce it later.
These Terms represent the complete agreement between you and FlyData Global regarding the Services and replace previous agreements or understandings relating to the same subject.
You are responsible for ensuring that your use of the Services complies with laws and regulations applicable in your location.
